38.1 If the claimant fails to submit a Statement of Claim, the sole arbitrator shall order the termination of the proceedings, unless there are remaining matters that may require a decision and the sole arbitrator considers it appropriate to do so.
38.2 If the respondent fails to submit an Answer to the Request for Arbitration, or a Statement of Defence, the sole arbitrator shall continue the proceedings without treating such failure in itself as an admission of the claimant’s allegations. The provisions of this Article also apply to the claimant’s failure to submit a defence to a counterclaim or set-off claim raised by the respondent.
38.3 If any party fails to appear at a hearing without good cause, the sole arbitrator may proceed with the hearing.
38.4 If any party otherwise fails to avail itself of the opportunity to present its case, the sole arbitrator may proceed with the arbitration and make an award based on the submissions and evidence before the sole arbitrator.
38.5 If a party, without good cause, fails to comply with any provision of these Rules or any order or direction issued by the sole arbitrator, the sole arbitrator may draw such inferences from the party’s non-compliance as it considers appropriate.
