FAI Expedited Arbitration Rules 2024
31.1 Within the time limit set by the sole arbitrator, the claimant shall submit a Statement of Claim to the respondent and the sole arbitrator. The Statement of Claim shall include:
(a) a statement of the facts and the legal arguments supporting the claim;
(b) the relief or remedy sought by the claimant; and
(c) to the extent possible, the documentary evidence the claimant intends to rely on.
31.2 Within the time limit set by the sole arbitrator, the respondent shall submit a Statement of Defence to the claimant and the sole arbitrator. The Statement of Defence shall include:
(a) any objections concerning the existence, validity or applicability of the arbitration agreement;
(b) a statement whether, and to what extent, the respondent admits or denies the relief or remedy sought by the claimant;
(c) a statement of the facts and the legal arguments supporting the respondent’s defence; and
(d) to the extent possible, the documentary evidence the respondent intends to rely on.
31.3 Any counterclaim or set-off claim by the respondent shall be raised no later than in the Statement of Defence, unless the sole arbitrator in exceptional circumstances determines that the respondent has a justified reason to raise a counterclaim or set-off claim at a later stage of the proceedings. Any such counterclaim or set-off claim shall comply with the requirements of Article 31.1(a)–(c).
31.4 Unless the sole arbitrator in special circumstances decides otherwise, the following shall apply:
(a) in addition to the Statement of Claim and the Statement of Defence, the parties may each file one written submission, including statements of evidence;
(b) the submissions must be brief; and
(c) the time limits within which the submissions shall be filed may not exceed 14 days.
31.5 The sole arbitrator may order any party to finally state its claim for relief within the time limit set by the sole arbitrator. After the expiration of the time limit, the party may not amend its claim for relief, unless the sole arbitrator in exceptional circumstances decides otherwise.
